By using the website, you consent to the collection and use of information in accordance with this privacy policy. Zelist Monitor reserve the right to change this privacy policy from time to time by changing it on the website. This privacy policy was last updated on May the 16th 2016.

Zelist Monitor also has a separate Indexed Content Privacy Policy which describes its practices regarding the processing of personal data collected as part of content that has been made publicly available on the Internet and that is accessed, used and maintained by Zelist Monitor in connection with the provision of the Services.

1. HOW DO WE COLLECT PERSONAL DATA THROUGH OUR WEBSITE?

We may collect and process the following personal information about you:
  • Information (such as your name, work email and postal address, telephone number, company name and country location) that you provide by completing forms on the website, upload or submit any material via the website or request any information from us;

5.1 Zelist Monitor collects information when you register or use grant to us the right to access your Facebook Insights info through Facebook Connect for a Zelist Monitor Service or otherwise voluntarily provide such information. By accepting the Privacy Policy, you expressly agree that (A) Zelist Monitor may use and process all personal information, including any sensitive personal information, that you provide when you register or use registration through Facebook Connect for a Zelist Monitor Service or otherwise voluntarily provide to us in connection with the Service, for the purpose of providing the Services to you; and that (B) Zelist Monitor may use and combine personal information collected from you with information from other Zelist Monitor Services to provide a better user experience, including Services that display customized content or advertising of our products or services. The use of such publicly available information is typically governed by the terms applicable to the service or network through which the data were made publicly available and such information may typically be used, accessed by and shared with third parties.

5.10 You agree that Zelist Monitor may use aggregated, anonymized data derived from the data provided by you or collected by the program analytics in its own statistics, for auditing, for the purposes of product and market research and analytics (which help Zelist Monitor to improve its products and the range of products and to develop new technologies, products and services), benchmarks and other analyses, and to publish them and to share them with third parties outside of Zelist Monitor. Zelist Monitor will not directly or indirectly transfer any data received from you to (or use such data in connection with) any ad network, ad exchange, data broker, or other advertising or monetization related toolset.

5.10 Zelist Monitor don't use any social media APIs that constitutes, promotes or is used in connection with spyware, adware, or any other malicious programs or code.

5.11 Zelist Monitor don't store or cache any login credentials for any social media platform.

5.12 Zelist Monitor respects other people's rights, and expect you to do the same. We remove within 24 hours any User Content or other information that the owner asks us to remove by a request sent to support@zelist.ro.

5.13 Zelist Monitor does not claim ownership of any Content that any user of any monitored source, blog or Facebook page post on.

5.14 Although it is Zelist Monitor’s intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. We guarantee an uptime of 98% calculated yearly. Also, Zelist Monitor reserves the right to remove any monitored Content from the Service for any reason, without prior notice. Zelist Monitor will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content.

In order to provide our Services (which comprise the monitoring and assessment of brands online e-reputations) through our platform to our clients, we collect and process content known as “Indexed Content” from a variety of publicly-available areas of Web sites, such as blogs, news Web sites, and social networking platforms (such as Facebook and Twitter). Indexed Content which is collected by us comprises data which is publically available on the internet and can be accessed through internet search engines or by visiting relevant websites directly. Indexed Content may also include personal data relating to individuals which is collected and organised in an aggregated basis. The personal data which is collected as a part of the Indexed Content includes, but is not limited to: (i) hobbies; (ii) product ratings; (iii) user preferences; (iv) social network ID’s; (v) user reviews, (vi) public profile photos, etc.

2. HOW DO WE USE YOUR PERSONAL DATA THAT MAY BE PART OF THE Indexed Content?

2.1 Who is the data controller of the personal data collected and for which purpose the data is collected?

Zelist Monitor is the data controller in relation to any processing of personal data collected as a part of the Indexed Content. We use the personal data collected as a part of the Indexed Content to provide our services to customers which may include, but shall not be limited to: (i) social media listening; (ii) data analytics (iii) analysis of brand perception and reputation in the online space; and (iii) analysis and perception of customers products online. Zelist Monitor’s customers may also process the personal data provided to them by the services for their own requirements. Where the customer processes the personal data for its own purposes, such processing is carried out under customer’s sole responsibility and shall be governed by the privacy practices of that customer. For any processing of this nature carried out by the customer, the customer shall be the data controller of such personal data.
